Non-Compete Clauses
The Government is looking at, from 2027, banning non-compete or restraint clauses for those earning below the High-Income Threshold (which is currently $183,100 per annum) and others in limited circumstances.
Other clauses on confidentiality, intellectual property and trade secrets will remain enforceable.
There will be transitional rules and won’t apply to past contracts and penalties will apply.
As it gets closer and more information comes to hand, we can advise more specifically however it once again makes it more important to ensure good HR is practiced to ensure retention, loyalty and engagement.
